Terms & conditions

These terms are a working draft prepared for the Gardening Careers platform. The sections marked § requires legal review below should be reviewed and approved by a suitably qualified solicitor before the platform accepts live registrations or paid listings.

1. Welcome to Gardening Careers§ requires legal review

Gardening Careers ("we", "us", "the platform") operates a specialist online recruitment marketplace at gardeningcareers.co.uk connecting individuals seeking work with employers offering roles across the UK's gardening, landscaping, horticulture, grounds maintenance and wider green industries.

We act as a platform host and facilitator. We are not an employment agency, employer, recruiter or party to any contract of employment formed between users. We do not employ candidates and we do not vet every employer or vacancy. By using the platform you acknowledge that recruitment decisions are made between candidates and employers directly.

2. Acceptance of these terms

By registering an account, posting a vacancy, submitting an application, or otherwise using the platform, you agree to be bound by these terms and our Privacy Policy. If you do not agree, you must not use the platform. If you are using the platform on behalf of an organisation, you confirm that you are authorised to do so and that the organisation agrees to these terms.

3. Eligibility & accounts

You must be at least 16 years old to register. Users under 18 may apply only for apprenticeship or trainee positions and may require the consent of a parent or guardian. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information when registering and keep your details up to date.

4. Candidate responsibilities

Candidates agree that the information in their profile, CV and applications is accurate to the best of their knowledge. You must not misrepresent qualifications, experience, eligibility to work in the UK, or any other material fact. Deliberate misrepresentation may result in removal of applications or suspension of your account.

Candidates are responsible for assessing the suitability of any role and for carrying out their own due diligence on employers. We encourage candidates to verify employer details before attending interviews or sharing personal information.

5. Employer obligations & job listing rules§ requires legal review

Employers are responsible for the accuracy, lawfulness and currency of every job advert they post. Adverts must relate to genuine vacancies in the UK green industries. Employers must comply with all applicable employment, equality, immigration and advertising legislation, including (without limitation) the Equality Act 2010, the Employment Agencies Act 1973 and associated regulations.

Employers must not post adverts that are discriminatory, misleading, fraudulent, or that charge candidates a fee for applying. We reserve the right to remove or decline any advert that, in our reasonable opinion, breaches these terms or is otherwise unsuitable. We may verify employer identities and request evidence before activating listings.

Employers may only access applications and candidate data relating to their own vacancies. Candidate data shared through an application must be used solely for the purpose of recruitment for that vacancy and handled in accordance with the Privacy Policy and applicable data protection law.

6. Applications & recruitment process

Submitting an application through the platform transmits the candidate's profile and application content to the named employer. We are not responsible for an employer's response time, selection decisions, or failure to respond. We do not guarantee that any application will result in an interview or offer. Any offer of employment is made solely by the employer and any contract of employment is between the candidate and that employer.

7. Acceptable use

You must not misuse the platform. Prohibited conduct includes, without limitation: posting false or misleading content; infringing the intellectual property or data rights of others; attempting to access data you are not authorised to view; scraping or harvesting candidate or listing data; using the platform to send unsolicited communications; or introducing malware or other harmful code. We may investigate and take action where we suspect misuse.

8. Account suspension & termination§ requires legal review

We may suspend, restrict or terminate any account, listing or application where we reasonably believe these terms have been breached, where required to protect other users, or where required by law. We may also remove content that is reported to us and found to breach these terms. We will act reasonably and, where practical, provide notice and an opportunity to respond, except where urgent action is needed to prevent harm.

You may close your account at any time. Upon closure, your profile will cease to be visible, though we may retain records as described in the Privacy Policy.

9. Intellectual property§ requires legal review

The Gardening Careers name, logos, visual design and platform software are owned by us and protected by intellectual property laws. You may not use them without our prior written consent, other than as required to use the platform in accordance with these terms.

You retain ownership of the content you submit (profiles, CVs, adverts). By submitting content you grant us a non-exclusive, royalty-free licence to host, display and process that content for the purpose of operating the platform, including presenting adverts and applications to the relevant users. You confirm that you hold the rights to any content you post and that it does not infringe the rights of any third party.

10. Fees

Creating a candidate profile and applying for roles is free. Posting a job advert is free during the platform's launch period. We may introduce paid plans, featured placements and subscription tiers in the future; details and pricing will be published before any charges apply. No payment processing is active until subscription plans are configured and tested.

Where paid services are introduced, fees are payable in advance, are non-refundable except as required by law, and may be changed on reasonable notice. Featured placements do not guarantee recruitment outcomes.

11. Liability & limitation§ requires legal review

The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we accept no liability for: the accuracy or lawfulness of adverts or profiles; the conduct of employers or candidates; the outcome of any recruitment process; or any loss arising from use of the platform or from any employment relationship formed through it. Nothing in these terms limits liability for death or personal injury caused by negligence, or for any other liability that cannot be excluded by law.

You agree to indemnify us against claims arising from your breach of these terms or your misuse of the platform.

12. Data & privacy

Our use of personal data is described in our Privacy Policy, which forms part of these terms. We process personal data in accordance with the UK GDPR and the Data Protection Act 2018.

13. Changes to these terms

We may update these terms from time to time. Where changes are material we will seek to give reasonable notice through the platform or by email. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
